50/50 Sweepstakes Entry

50/50 Sweepstakes = is 50% of the proceeds raised during that event are distributed to the winner in the form of an Amazon Gift Card

A sweepstakes drawing (the “sweepstakes”) will take place during each Live Charity Auction, on the Second Saturday of each month (the “Auction”). NO PURCHASE NECESSARY TO PARTICIPATE IN THE SWEEPSTAKES.

A sweepstakes drawing will take place during the Game referenced above, and will be conducted by Disabled Artists Foundation, Inc., 16970 San Carlos Blvd. #160-106, Fort Myers, FL 33908 (“dAFi”). These are the official rules relating to the sweepstakes drawing. There are two (2) ways to enter the sweepstakes drawing: i) obtain a chance entry for the sweepstakes (an “Entry”) at www.disabledartists.org/entry during the Game, up near the end of the respective auction as identified in the entry purchase on the website. Entries are available for a suggested donation of 5 for $5. Pursuant to the laws of Florida, no purchase or contribution is necessary to enter the sweepstakes drawing, and one Entry may be obtained without buying an entry during the Game by mailing a letter or post card to Care Hart stating your request for the free entry and have it postmarked at least 5 days in advance of the winner announcement mailed to 16970 San Carlos Blvd #160-106 Fort Myers, FL 33908. In the event that a sweepstakes is announced less than 5 days in advance, a person can email Care at help@disabledartists.org requesting the free entry. Each Entry will be placed into the Excel managed by dAFi with a fair and balanced macro encoded to randomly select a winner for the prize (as hereinafter defined). dAFi will retain a record of the Name that corresponds to each Entry that is provided to a Participant.

Claim - To receive the prize - Upon winning, the winner receives an email requesting they complete the winner form. Completion of the form is required within 29 days of receipt to claim the prize(s). This form is used as proof they are in the United States and over 21 as required to win.

Privacy Policy - Any information directly or incidentally collected by dAFI will only be used for the purposes of dAFi, not be sold or shared

Participation Requirements

Each person who obtains a Entry for participation in the sweepstakes (a “Participant”) must be 21 years or older to participate. dAFi is not responsible for: (i) technical, hardware or software malfunctions, lost or unavailable network or internet connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender or by any of the equipment or programming associated with or utilized in the sweepstakes; (ii) the incorrect or inaccurate capture of information regardless of the cause; (iii) errors of any kind whether human, mechanical, electronic, network or otherwise arising out of or relating to the sweepstakes; (iv) theft, loss, or destruction of, or damage to the electronic format of Entries, in whole or in part; (v) electronic or other communications which are undeliverable or fail to be delivered, for any reason; and (vi) any other factors beyond the reasonable control of the dAFi. Each Participant assumes all risk of early, late, incomplete, invalid, incorrect or misdirected Entries. All Entries are the exclusive property of the dAFi. Any unauthorized person copying, selling or altering a Entries will be subject to prosecution. An Entry will be voided and no prize will be awarded if there is proof that the Entry was stolen, unissued, ineligible, altered, counterfeit in whole or in part, defective, produced in error.

Selection of Winner / Claiming Prize

No electronically reproduced Entries or illegible, early, late, incomplete, forged, or altered Entries will be accepted. dAFi is not responsible for: (i) technical, hardware or software malfunctions, lost or unavailable network or internet connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender or by any of the equipment or programming associated with or utilized in the sweepstakes; (ii) the incorrect or inaccurate capture of information regardless of the cause; (iii) errors of any kind whether human, mechanical, electronic, network or otherwise arising out of or relating to the sweepstakes; (iv) theft, loss, or destruction of, or damage to Entries, in whole or in part; (v) electronic or other communications which are undeliverable or fail to be delivered, for any reason; and (vi) any other factors beyond the reasonable control of the dAFi. Each Participant assumes all risk of errored, lost, early, late, incomplete, invalid, incorrect or misdirected Entries. All Entries are the exclusive property of the dAFi. Any unauthorized person duplicating, selling or altering Entries will be subject to prosecution. Entries will be voided and no prize will be awarded if there is proof that the Entries was stolen, unissued, ineligible, altered, counterfeit in whole or in part, defective, printed in duplicate or printed/production in error.

Selection of Winner/Claiming Prize: All donations collected by dAFi in connection with each sweepstakes will be pooled into a single sweepstakes pool (the “sweepstakes Pool”). One Entry will be selected from all of the Entries in connection with the sweepstakes (the “Drawing”), and the Name associated with that Entry will be announced. The Participant who can present the Entry with the same Name as the announced Name will be the winner (the “Winner”). The Winner will win fifty percent (50%) of the sweepstakes Pool (the “Prize”). The Drawing will occur during the last 30 minutes of the auction. The winning Entry will be chosen at random. Immediately following the Drawing, the Name of the winning Entry will be announced at the Auction. After the Game during which the Drawing occurred, the winning Name will be emailed a direct announcement that they are the winner. The Winner does not need to be present at the Auction to win. The Winner has thirty (30) days after the Drawing to claim the Prize. The person may choose to enter as Anonymous as an option to give their winnings back to dAFi as a donation, so if the Name randomly chosen as the winner equals “Anonymous” the winner elects to gift their 50% winnings back to dAFi immediately upon announcement of the winner. To claim the Prize at the Game, the Winner may send a confirmation email to HELP@disabledARTISTS.org at any time after the Drawing until 72 hours following the end of that same auction. The Winner will be directed on what needs to occur for the Winner to claim the Prize. Provided the Winner cooperates with dAFi’s requirements for claiming the Prize, the Prize will be paid to the Winner via PayPal within approximately thirty (30) days from the date of the Drawing. If the Winner does not claim the prize at the Game, the Winner may present evidence that it has the winning Entry to dAFi within thirty (30) days after the Drawing. To do this, the Winner must e-Mail HELP@disabledARTISTS.org, and a representative of dAFi will inform the Winner of what needs to occur for the Winner to claim the Prize, and provided the winner cooperates with dAFi’s requirements for claiming the Prize, a PayPal deposit will be made directly to the winner within thirty (30) days of presenting the winning Entry in accordance with the requirements set forth by the representative of dAFi. If the Winner does not present evidence that it has the winning Entry to dAFi within the time frame set forth herein, or does not cooperate with dAFi’s requirements for claiming the prize, the Winner waives its right to receive the winnings, and any proceeds the Winner would have received will be donated to dAFi. Applicable taxes are the sole responsibility of the Winner. As such, in order for the individual with the winning entry to claim the Prize, the Winner must present the following to a representative of dAFi: For U.S. Persons – For any Prize amount that less than $600 in US currency; the winner must provide proof they are the Name announced, one proper form of identification (Driver’s License or ID Card which displays the winner’s name and Date of Birth). For any Prize amount that equals or exceeds $600 in US currency; the winner must fill out a W-9 tax form, and provide one proper form of identification (Driver’s License or ID Card which displays the winner’s name and Date of Birth). If a Taxpayer Identification Number (i.e. Social Security Number) is not provided on the W-9, a backup withholding of 28% of the winner’s proceeds will be taken and submitted to the IRS on behalf of the Winner. For Foreign Persons – The 50/50 sweepstakes is invalid unless the Entry is provided by a person physically present in the state of Florida and a W-8BEN tax form must be filled out and a backup withholding rate of 30% on the winner’s proceeds will be taken and submitted to the IRS on behalf of the Winner. Any Winner must comply with any and all requirements set forth by dAFi in connection with the Winner collecting the Prize. Other provisions: The designated Entry, with the winning Name, is the only valid receipt for claiming the Prize. dAFi is not responsible for lost or corrupted entry or entries redeemed in error by its agents. All Entries, transactions, and Winners associated with the sweepstakes are subject to state law, federal law and the rules, regulations and procedures put in place by dAFi.
